UPDATE: New Analysis of Treasury Rules Shows 42 Million Married Couples Can Claim $3,400 Through Education Freedom Tax Credit
DALLAS, Texas – American Federation for Children Growth Fund Senior Fellow Patrick Graff, Ph.D. today released an updated analysis of the Treasury Department’s proposed rules, showing that more than 42 million married couples can claim the full $3,400 through the Education Freedom Tax Credit, potentially funding more than two million additional scholarships. The new guidance establishes a clear framework for implementation and clarifies that there will be no “marriage penalty” for these couples filing jointly, both of whom will be eligible to contribute up to $1,700 and receive a dollar-for-dollar tax credit starting in 2027.
Key takeaways from the updated analysis include:
- Of the 50.5 million married couples filing jointly who owe federal income tax, 42.2 million owe at least $3,400. If married couples give at the same rate as other filers, this adds $3.8 billion a year in funding for every 5 percent increase in donor participation.
- Treasury’s funding projection at 10 percent participation matches AFC Growth Fund estimates, funding approximately 3.5 million $7,000 scholarships or 7 million $3,500 scholarships. Only K-12 students in states that have opted in may receive a scholarship.
- If donor participation were to reach 10%, funding under the Education Freedom Tax Credit would increase federal support for education by roughly 33%, delivered directly to students as scholarships for educational expenses.
- Of the 121.5 million tax returns that owe federal income tax, 96.5 million (79.4 percent) owe enough to claim the full credit: $1,700, or $3,400 for married couples filing jointly. Another 25 million can claim a credit up to their full liability.
This is an unprecedented opportunity for Americans across nearly every income level to reduce their federal tax liability and support public and private school students for educational expenses like tutoring, tuition, special education services, and other critical academic supports.
The updated analysis follows a recent report released by Dr. Graff estimating nearly 52 million children will qualify for a scholarship under the Education Freedom Tax Credit. View estimates for every state, including an interactive map, and download the full report here.
Statement by Tommy Schultz, CEO, American Federation for Children:
“The Education Freedom Tax Credit has the potential to transform education for millions of children, and Treasury’s latest guidance brings us one step closer to realizing its full impact. By allowing married couples filing jointly to contribute up to $3,400, more Americans will be able to support K-12 scholarships. AFC’s new analysis shows that 42 million married couples could benefit from this provision, generating an estimated two million additional scholarship opportunities for students across the country. As we prepare for the January 1 launch, we’re committed to ensuring this historic tax credit delivers for families nationwide through our continued advocacy efforts and the AFC Scholarship Fund.”
Statement by AFC Growth Fund Senior Fellow Patrick Graff, Ph.D.:
“Treasury’s extensive proposed rules resolve most of the remaining open questions about the Education Freedom Tax Credit. This new tax credit puts education philanthropy within reach of nearly every American taxpayer. A married couple can now give the full $3,400 annually for about $283 per month. By affirming that employer-facilitated payroll deductions qualify, the rules make it easier for taxpayers across income levels to contribute through their paychecks without reducing their monthly take-home pay. At 10 percent taxpayer participation, the removal of the marriage penalty alone could fund more than two million additional scholarships a year.
“Treasury’s proposed rules also align with our understanding of student eligibility by adjusting income limits for family size, expanding eligibility to an additional 500,000 K-12 students in families with five or more members in comparison to a flat four-person income limit. This adjustment is particularly meaningful for larger families in lower-income or rural areas, helping ensure that deserving students are not left behind.
“Together, these proposed rules expand educational opportunities for families while making it easier for taxpayers to support scholarship organizations in their own communities.”
