AFC Congratulates New Hampshire’s Legislature for Passing Landmark School Choice Bill
Dallas, Texas – The American Federation for Children congratulates New Hampshire’s legislature for passing SB 295 in Concord Thursday. Upon Governor Ayotte’s signature, New Hampshire will become the 17th state to pass legislation creating school choice options for every family.
The legislation makes all New Hampshire students eligible for the current Education Freedom Account program by removing income limits for participation. It allows for fiscally responsible growth by setting enrollment caps that increase annually based on demand. Importantly, it maintains the program’s traditional focus on prioritizing students with disabilities and students from low-income households by exempting them from the cap.

Details:
- Expands Education Freedom Accounts (EFAs) for families to use to offset education-related expenses including private school tuition, homeschooling curriculum, tutoring, and more.
- Creates universal eligibility for EFAs by removing income requirements.
- Prioritizes students from households earning less than or equal to 350% of the federal poverty level, students with disabilities, and current EFA students and their siblings.
- Builds in budget predictability by implementing a 10,000-student cap for the 2025–2026 school year. This cap increases by 25% annually based on program participation.
- Removes the enrollment cap after two consecutive years of not requiring an increase.
