AFC Condemns Kentucky Supreme Court’s Decision to Strike Down Charter Schools Funding, Calls on State to Opt In to Education Freedom Tax Credit

DALLAS, TX – The American Federation for Children is standing behind Kentucky families as the Kentucky Supreme Court’s decision to strike down the state’s charter schools funding law increases the urgency for the state to opt in to the federal Education Freedom Tax Credit (EFTC).

The court ruled that Kentucky’s 2022 charter schools funding law — passed by the legislature over Gov. Andy Beshear’s veto — violates the state constitution. This decision is the latest in a long series of setbacks for education freedom in the state. Kentucky must opt in to the EFTC so that its families can benefit from the same options that families in dozens of other states across the country already enjoy.

The ruling deals a serious blow to families who have long sought more educational options for their children. Thankfully, there is still another opportunity with the EFTC, which can provide options for families in every state.

“Today’s ruling is a profound disappointment for every Kentucky family that has been waiting, many for years, for a real educational alternative. This decision does not end the fight for education freedom in Kentucky; it highlights the urgency for Kentucky to opt in to the Education Freedom Tax Credit immediately.

“Although the courts have tied lawmakers’ hands on in-state options, the EFTC offers a constitutionally sound path to finally deliver choice to Kentucky families, without costing the state a dime. Governor Beshear and all Kentucky officials have an opportunity right now to act, and we urge them to seize it. Kentucky’s children cannot afford to keep waiting.”
